Copyright Dispute Escalates Between Dhanush and Nayanthara Over 'Naanum Rowdy Dhaan' Footage
Usage of a three-second clip of the Bangtan Boys, or BTS, in Nayanthara’s Netflix documentary Nayanthara: Beyond The Fairytale has now become a war of words between two highly influential actors of the Tamil film industry.
The controversy centering around this issue is with reference to this usage as having been taken from the 2015 movie Naanum Rowdy Dhaan. This minor insert has sparked a lawsuit that has gripped fans’ attention and, by extension, caused further debate within the industry on issues of copyright and ethical usage.
Background of the Dispute
Dhanush featured in Naanum Rowdy Dhaan but was also its producer. He filed a case against Nayanthara for allegedly using material belonging to him without permission.
The clip in question was a BTS shot during the making of the movie that later appeared in the trailer of Nayanthara’s documentary. Dhanush claims the clip is his intellectual property as he is the producer of the film.
He has sent a legal notice to Nayanthara demanding ₹10 crore compensation for what he deems to be unauthorized usage.
In response, Nayanthara released an open letter on Instagram stating that Dhanush acted out of personal animosity.
She elaborated that her team had approached him for permission over two years ago and could not confirm it, while evidence showed the footage was used assuming it is public or personal content that did not require explicit permission.
Escalation and Legal Proceedings
The matter further flared up as Dhanush filed a suit in the Madras High Court for an injunction to restrain any further use of the footage.
Although the judgment is yet to come, this litigation has led to a larger controversy over various legal and ethical questions that surround ownership and fair use of content.
Legal Issues
Three primary legal considerations arise from this case:
1. Ownership of Copyright
According to the Indian copyright law, all the rights regarding that film and any footage of BTS in it are owned by the producer in general.
The producers of Naanum Rowdy Dhaan, Dhanush claim all the rights pertinent to the controversy footages, unless defined otherwise in the contract.
On the other hand, the camp of Nayanthara has argued that footage was recorded by personal devices during the course of the whole production.
In this way, they questioned whether the recording in question is a work under the copyright owner of the producer.
Relative in ownership is used if made not through processes for formal productions
2. Fair Use and Fair Dealing
Section 52 of the Indian Copyright Act provides for “fair dealing,” which includes limited use of the copyrighted material for purposes, such as critique, commentary, or education.
Nayanthara’s defense is strictly based on the argument that the clip was used in a biographical context, showing light into her life and career, potentially qualifying it as falling under “fair use.”.
The argument posed forward by Dhanush’s lawyers is that even if the footage is used briefly for personal or biographical material, permission is required, especially if the footage is related to a copyrighted work like Naanum Rowdy Dhaan.
3. De Minimis Doctrine
The de minimis doctrine is a legal principle which holds that minor or insignificant uses of copyrighted material may not be considered infringement.
Given the clip was only three seconds long, Nayanthara’s team has argued that it falls under this principle. However, Dhanush has emphasized that intellectual property must be respected, regardless of the length or perceived insignificance of the material.
Public and Industry Reactions
Public as well as film fraternity reactions are mixed since the case is already filed. While many have joined Nayanthara’s side claiming that the use was non-commercial and pretty minimal considering the genre of the documentary,
others shifted their allegiance towards Dhanush’s camp emphasizing the need to draw clear-cut boundaries and lines of respect among all creative collaborative efforts when dealing with copyright issues.
Legal experts also commented on the issue, citing lack of clear contractual guidelines governing many Indian film productions.
Such disputes could easily be prevented if filmmakers and producers clearly establish agreements over ownership of BTS footage and personal recordings during production.
Copyright Implications
This argument opens the debate on the ethics of content creation in entertainment and the challenges it poses to copyright law. Questions include:
1. Personal Recordings: Does such material shot on private devices, when accidentally used as filming devices, automatically pass on to the producer or do the creators of the material retain ownership?
2. Fair Use in Biographical Situations: How much freedom can creative authors enjoy in copying copyright material for biography or documentary situations without individual license or permission?
3. The prayer for clarity over the contract: Is the production contract to mention in detail the rights of ownership to all personal and BTS footage?
Status as of date
It is one of the more interesting cases under the Madras High Court, where Dhanush continues his filings for damages and an injunction against the use of the footage, and Nayanthara’s team argues that it is merely a clip of fair use or the de minimis doctrine.
That it may lead to wider repercussions as far as making the Indian film industry understand clear laws on copyrights and what stands as ethical borders around personal verses content is concerned.
The row between Dhanush and Nayanthara over footage from Naanum Rowdy Dhaan brings into focus this thorny issue of copyright in the entertainment industry. A very trivial piece of a clip is the central theme here,
yet it involves bigger issues related to copyright and content ownership, fair use, and ethical filmmaking. As the case goes on, it also brings to memory people about the importance of clear agreements and mutual respect in creative collaborations.
